4. | Description | Abstract | The National Sharia Arbitration Board (BASYARNAS) is one of the arbitration institutions that has the authority to resolve sharia business disputes. BASYARNAS has its own arbitration procedure law which can be made a legal choice for parties to the dispute regulated in the BASYARNAS Rules of Procedure. However, in order to submit a settlement of Islamic business disputes through BASYARNAS, the applicant must remain based on an arbitration clause or an arbitration agreement. The problems revealed here are the role of BASYARNAS in solving sharia economic disputes, procedures for resolving sharia business disputes through BASYARNAS, as well as problems in solving sharia business disputes through BASYARNAS. The role of BASYARNAS in the resolution of Islamic economic disputes is as a body that can resolve Islamic civil / Muamalat disputes by deciding a legal decision on a dispute that is disputed in a judicial manner. Where the decision that has been determined by BASYARNAS regarding cases submitted to it is binding and final (there is no appeal or appeal). The procedures for resolving disputes through BASYARNAS are as follows: petition for arbitration, appointment of a single arbitrator or assembly arbitrator, answer of the respondent, peace, proof of witnesses or experts, revocation of petition, decision, registration of decision, and execution of BASYARNAS decision. There are 3 problems that are still being felt by BASYARNAS; first, regarding HR which is still limited, secondly, funds are still minimal and third, BASYARNAS has not yet been socialized as a body for resolving Islamic economic disputes. |
